This privacy policy (“Privacy Policy”) governs the privacy practices of American Corporate Partners (“ACP,” “us,” “our” and “we”) regarding the ACP Website (the “Website”), including the application process for ACP’s mentoring program (the “Program”). We are committed to protecting your privacy. Please read carefully the following description of our policies and practices regarding your personal information before using or accessing the Website. By using and/or accessing our Website, you signify your agreement to this Privacy Policy, including but not limited to, the collection and use of your personal information as outlined in this Privacy Policy.

Information Collection

Generally, ACP does not collect personal information about you when you visit the Website, unless you choose to provide such information to us. You can visit most portions of the Website without disclosing any personal information. However, ACP and its agents and representatives may collect personal information from you under certain circumstances. For example, when you submit an online veteran application or corporate mentor application to apply for the Program, such application will require you to share personal information about yourself, including your name, street, city and state address, zip code, e-mail address, telephone number, age, employment status, educational background and other background information, including any criminal offenses. For veteran applications submitted online, veterans may attach their résumés, but such an action is not required. Once a veteran is accepted into the Program, ACP will request information about the veteran’s service record and career, which may be submitted via e-mail, mail or fax. Applications may also be printed and then submitted in paper form to ACP. If you do not provide all of the information necessary to process your application, your application may be delayed or denied. The applications may also request additional optional information, which you may or may not provide. When you apply to the Program, we may maintain a record of the transactions related to your application. We may collect personal information as required or permitted by law, or with your consent. Subject to contractual and legal restrictions, you may withdraw your consent at any time upon reasonable notice, but if you do so, we may not be able to provide some of our services.

Opt-in

You have the right not to provide us with any personal information about you when you visit the Website, but you will not be able to apply for the Program unless you voluntarily decide to print out the application form and submit it to ACP or complete an online application form. You can also decide not to provide optional information that is requested on an application and still apply for the Program.

Information Use

We may use your personal information to communicate with you regarding the Website, the Program, disputes or inquires submitted by you. Any personal information submitted to us, or to our third-party service providers acting on our behalf, will not be sold, leased or shared with or to anyone else by us, unless we notify you otherwise in advance, except as follows:

(1) We may share your personal information with the references you have provided to us as part of the application process in order to verify the information you have entered on your application.

(2) We may share your information with our third-party service providers, to the extent that they may provide certain services.

(3) If ACP is sold, your information may be part of the assets we transfer. Your information also may be disclosed if ACP is considering or completes the financing, securitization, insuring, sale, assignment or other transfer of all or part of ACP.

(4) We may disclose your information to comply with any judicial or governmental subpoenas, warrants or orders. We reserve the right to use, disclose and share your information to investigate, prevent or take action with respect to any potential or actual fraud, illegal activities, circumstances which threaten the physical safety of any person, violations of the Website’s Terms & Conditions or as otherwise required by law.

Security

We employ security measures, such as SSL encryption methodology and the use of passwords and usernames to ensure information is only accessible by ACP staff, to prevent the unauthorized access, disclosure, loss or destruction of personal information. However, we cannot guarantee that the information we have gathered will never be accessed, disclosed, lost or destroyed in a manner that is inconsistent with this Privacy Policy.

Revising/Deleting Your Personal Information

You may contact ACP at info@acp-usa.org if you wish to revise the information submitted on your application. Notification of Changes

This Privacy Policy may be amended or modified at the sole discretion of ACP and new conditions may be imposed at any time without notice. This posting will be updated to reflect any such changes or additions. Notices of changes to the Privacy Policy may be generally displayed on the Website. Please periodically check the Privacy Policy for changes. Continued use or access by you of the Website following the posting of any changes to the Privacy Policy signifies your agreement with those changes. All such changes are hereby incorporated by reference into the Privacy Policy.

Choice of Law

Any disputes arising between you and ACP regarding this Privacy Policy shall be governed by the laws of the State of New York without regard to its conflict of law provisions. You and ACP agree to submit to the personal and exclusive jurisdiction of the courts located within the county of New York, New York. You hereby waive any argument that any such court does not have jurisdiction over you or that such dispute or venue in any such court is not appropriate or convenient. ACP will be entitled to recover its court costs and reasonable attorneys’ fees and expenses incurred if it successfully proves your violation of any term of this Privacy Policy.
